Jogja Police Watch Terus Pantau Kasus Sate Beracun
YOGYAKARTA – Masih ingat kasus sate beracun yang mengambil nyawa anak tukang ojek online beberapa waktu lalu? Sejauh ini, Jogja Police Watch (JPW) terus memantau kasus tersebut. Termasuk soal pemeriksaan kejiwaan terhadap tersangka Nani Aprililiani Nurjaman dalam kasus sate beracun yang mengakibatkan Naba Faiz Prasetya meninggal dunia.
Menurut Kadiv Humas JPW Baharuddin Kamba ada beberapa hal yang patut disampaikan terkait pemeriksaan kejiawaan terhadap tersangka.
“Jika merujuk pada penangkapan tersangka Nani ini pada tanggal 25 April 2021, namun pada 4 Agustus 2021 tersangka Nani menjalani tes kejiwaan atas petunjuk dari jaksa. Artinya, ada jedah waktu selama lebih kurang 4 bulan lamannya, terhitung sejak penangkapan tersangka, baru dilakukan tes kejiwaan terhadap tersangka Nani,” ungkap Kamba, Selasa (24/08/2021).
Karena itu, JPW melihat kejanggalan akan hal tersebut, kenapa baru dilakukan tes kejiwaan terhadap tersangka Nani? JPW penasan, kenapa tidak dari awal kasus ini terungkap saja dilakukan tes kejiwaan terhadap tersangka Nani.
“Ini yang perlu jawaban termasuk hasil pemeriksaan kejiwaan terhadap tersangka Nani kenapa baru diungkap pada saat persidangan nanti?,” kritik Kamba.
Kamba mengatakan hal tersebut karena dirinya merujuk pada pasal 44 ayat (1) KUHP yang berbunyi, “Barang siapa yang melakukan perbuatan yang tidak dapat dipertanggungjawabkan kepadanya karena jiwanya cacat dalam pertumbuhan atau terganggu karena penyakit, tidak dipidana.”
Ia melihat, jika nantinya dipersidangan hasil tes kejiwaan tersangka Nani mengalami gangguan jiwa, kasus ini dapat dihentikan demi hukum sesuai Pasal 109 KUHAP.
Karena itu, ia menegaskan, JPW tetap mengawal kasus tersebut hingga ke pengadilan. Karena dari awal menduga kasus ini ada kejanggalan. Mulai dari keberadaan sosok R yang hingga kini masih misterius. Demikian juga dengan dugaan nikah sirih antara tersangka Nani dengan Aiptu Tomy, polisi yang menjadi target sate beracun, meski akhirnya dibantah.
“Termasuk apakah Aiptu Tomy dan istrinya masuk dalam BAP atau tidak. Kita tunggu dan kawal hingga ke pengadilan,” tegasnya.(****)
